U.S. taxes for Americans in Poland: what to file, and how to catch up.

Polish-American families, dual citizens and professionals in Warsaw and Kraków make up a growing community, and all of them still file a U.S. return every year. The U.S.-Poland tax treaty dates from 1974, and the U.S. still taxes its citizens. The details to get right are Poland’s retirement accounts and Polish funds. Most people who fell behind can catch up under the Streamlined procedures, with no penalty if they qualify.

How does the IRS treat Polish pensions and savings?

Every one of these goes on your FBAR. What differs is how the IRS taxes them.

AccountU.S. treatment
ZUS pensionPoland taxes it, and the U.S. can too, with a credit for the Polish tax.Mostly friendly
PPK (employee capital plans)Contributions, including your employer’s and the state’s, could be taxable for the U.S. as they’re made, and the funds inside can be PFICs.Watch out
IKE and IKZETax-favored in Poland only. Growth may be taxable for the U.S., and funds inside are often PFICs.Watch out
Polish funds (TFI)Usually PFICs (Form 8621), with complex reporting and tax rules.Watch out
Bank accountsInterest is taxable for the U.S., and the accounts count toward your FBAR total.Taxable
Polish treasury bondsPopular retail savings bonds. The interest is taxable for the U.S., with a credit for the 19% Polish tax on it, and they aren’t PFICs.Taxable

Which Polish investments are PFICs?

Polish investment funds run by TFIs, the funds inside PPK, IKE and IKZE accounts, and European ETFs bought through Polish brokers. For U.S. tax they’re passive foreign investment companies, or PFICs.

  • Each fund needs its own Form 8621 in most years, and gains can be taxed at the top U.S. rate plus an interest charge, unless an election was made in time.
  • PPK puts many employees into funds automatically, so it’s often the first PFIC an American in Poland has, without choosing it.
  • Not PFICs: shares of individual companies on the Warsaw exchange, treasury bonds, and bank deposits.

What does the U.S.–Poland tax treaty actually say?

The treaty in force was signed in 1974. A newer one was signed in 2013 but hasn’t taken effect. For Americans living in Poland, these parts matter most:

  • Citizens stay taxable. The U.S. keeps the right to tax its citizens living in Poland, as under every U.S. treaty.
  • Relief from double tax. The U.S. gives a credit for Polish income tax on the same income, including the 19% flat tax on interest and gains.
  • It predates modern pension rules, so it doesn’t defer U.S. tax on PPK, IKE or IKZE accounts.

Social security contributions are covered by a separate U.S.–Poland agreement, which generally means you pay into one system, not both. Read the U.S.–Poland tax treaty on IRS.gov.

When are Polish and U.S. taxes due?

Both tax years run January to December, so each Polish year lines up with one U.S. return. Your PIT-11 from your employer gives most of what the U.S. return needs.

Foreign tax credit or exclusion: which wins in Poland?

It depends on your salary. Polish income tax is 12% up to a threshold and 32% above it:

  • Higher earners taxed at 32% usually do best with the foreign tax credit, which covers the U.S. tax on the salary.
  • At moderate salaries, Polish tax at 12% can be less than the U.S. tax, so the foreign earned income exclusion, up to $130,000 for 2025, may do more.
  • Families with children often keep the credit, because it allows the refundable part of the U.S. child tax credit, up to $1,700 per child for 2025.

We run your returns both ways before choosing. How we compare the exclusion and the credit.

A worked example: a dual citizen in Kraków

Kasia was born in Chicago to Polish parents and moved to Kraków in 2015. She earns PLN 180,000 at a software company, is enrolled in PPK, and saves in an IKE invested in a TFI fund. She has never filed a U.S. return.

ItemHow it’s handled
SalaryWe compare the exclusion and the credit; either way her U.S. tax on it is usually little or nothing.
PPKOn the FBAR. Contributions could be taxable for the U.S. as they’re made, and the funds inside are PFICs.
IKE fundA PFIC: a Form 8621 in each year filed.
Catching upThree years of returns and six FBARs under the Streamlined procedures, with no penalty if she qualifies.

Catching up from Poland

Most Americans in Poland who fell behind without meaning to can catch up under the Streamlined Foreign Offshore Procedures: three years of returns, six years of FBARs and, if you qualify, no penalties. If only FBARs are missing, or you’ve moved back to the U.S., another route may fit better. See every IRS catch-up option for expats, compared.

Common questions

Do I pay U.S. Social Security tax in Poland?

Generally not if you pay into the Polish system. The U.S.-Poland totalization agreement prevents paying into both systems for the same work in most cases.

I’m a dual citizen who has never filed. Is it too late?

No. Under the Streamlined Foreign Offshore Procedures you usually file the most recent three returns and six FBARs.

How do you handle złoty amounts?

We convert using the correct IRS exchange rates for each year and account. It’s routine for us.

Should I opt out of PPK?

Not before looking at the numbers. The employer and state contributions are real money, but PPK adds U.S. reporting and possibly U.S. tax. We’ll show you both sides.

Is my ZUS pension taxed by the U.S.?

It can be. Poland taxes it, and the U.S. can too, with a credit for the Polish tax so you’re not taxed twice in full.

Does the Polish 19% tax on interest count as a foreign tax?

Yes, generally. The flat 19% tax on interest and gains can count toward the U.S. foreign tax credit on that income.
